Changing my tenancy agreement

Your Tenancy agreement is the document that you sign when you become a tenant of the Council.  Sometimes your circumstances change which may mean that you need to change your agreement with us. 

The changes could include:

• Ending your tenancy – for example, you may be moving to another property not owned by the Council.
• Mutual Exchange – you swap homes with another tenant (either from the same Council or another social landlord) and you take on that agreement for the home you have swapped to.
• Ending a joint tenancy – if you hold a joint tenancy and one of the joint tenants wants to end the tenancy, you need to contact the council for advice as the council does not have to reissue the tenancy as a single tenancy and may decide to end the tenancy altogether.  This decision is made depending on your circumstances.
• Succession – if a tenant dies it is sometimes possible for the other person living at the property to take on the tenancy.  This is usually when the deceased tenant was a partner or a close family member.
• Assignment – is when, subject to certain circumstances, the tenant transfers their tenancy to someone else living at the property in their lifetime.
• Transfers – if your housing need changes and you need a larger property or you wish to downsize, you will be assessed in accordance with our allocations policy and may be added to the housing waiting list, where you may transfer to another property and sign a new tenancy agreement for that property.

In all of the above instances you need to contact your Neighbourhood Officer to ensure you understand the implications of changing your tenancy and the process involved in changing your tenancy.  You also may want to seek independent advice.
